Some brief comments on Crytek's response to Star Citizen (as CGM isn't doing another full analysis until February)

Hi all!

I'm Robert B. Marks, the author of the two legal analysis articles for CGM (Comics and Games Magazine) about Crytek v. Cloud Imperium (http://www.cgmagonline.com/2017/12/19/crytek-v-star-citizen-closer-look/), (http://www.cgmagonline.com/2018/01/12/crytek-v-star-citizen-defense-lands/). We will be providing coverage, but we've decided to wait until the motion is heard on February 9th before publishing a longer analysis. Until then, a few comments after reading the response...

  • There isn't anything too surprising here (that said, it is gratifying to see the response hit many of the points that I had outlined/predicted). It should be noted that at this point in the proceedings, Crytek only has to demonstrate that their claims are worth the court's time - they don't have prove anything or land a knockout blow (nor can they at this point in time).

  • For Squadron 42, there are now functionally two "de minimis" ("the law cares not for insignificant things") arguments put forward. CIG is claiming that it does not matter that S42 was defined as a separate game in the preamble and a feature in the exhibits, all that matters is that it was covered by name in the agreement. Crytek is arguing that it does not matter that S42 was mistakenly listed as a separate game in the preamble, all that matters is that the GLA was for a single game, and did not cover two games. This could go either way (the clarification paragraph in the exhibit can back up Crytek's reading, but that's up to the judge, and this may not be decided until the communications during the GLA negotiations are entered into evidence).

  • On a strictly strategic level, Cloud Imperium probably comes out ahead in this engagement, regardless of what the judge rules. Even if the judge rules completely against them, they now have a better look at Crytek's trial strategy, along with at least part of the list of precedents and legislation they will be relying upon. And that helps them better craft their defence.

  • We are very unlikely to see any additional evidence entered as we are still in the Pleadings stage (in fact, we were extremely lucky to be able to see the contract this early).

  • The arguments over the non-compete clause are probably going to get VERY interesting. The question is: does it refer to creating, licensing, and selling a game engine, or just making use of a competing game engine? This is another thing that could go either way, although I have the funny feeling it will be a bit of a hard sell when it comes to Crytek's argument based on the fact that the clause refers to the "business of," instead of just the action itself.

So, that's it for now - like probably a lot of other people here, I (and my editors at CGM) are watching this with bated breath, and can't wait for what's next. That said, I really do want to caution against making predictions or declarations about who is going to win - it is WAY too early for that. We are only in the opening stages of this dispute, and trying to declare a winner at this time is rather like trying to declare the winner of a space battle based on whose laser cannons made the loudest hum when they were turned on.

(And, for disclosure, I'm a legal researcher associated with Bien Law, not a lawyer or paralegal. Also, when I was writing Garwulf's Corner for the Escapist, there was a dispute between Defy Media and CIG that I was not involved or privy to.)

Which games made a bad first impression but eventually won you over?

You ever play a game that really does not impress you at all at first but you still decide to keep going against your better judgment? Has one of them ever turned it around and won you over after a certain point?

For me recently it's been Pyre. I loved Bastion back in the day but bounced hard off of Transistor so I wasn't sure about Pyre, and the first couple of hours certainly didn't impress me much. It's one hell of a slow burn, the early Rites are dead simple and it bombards you with names upon names at first... but eventually it all starts coming together and the world building actually ends up being really impressive.

I was not expecting such a cohesive and well-developed world from Supergiant Games and the gameplay after you get all your party members and you reach the main "big" moment ends up being really enjoyable (not to mention the music kicks all sorts of ass but that's to be expected from them). I was lukewarm on the cast of characters at first but they eventually won me over, they're no Mass Effect cast or anything but they're an enjoyable bunch of weirdos.

Kirby Battle Royale on Nintendo 3DS is a somewhat fun mini-game collection, but one that doesn't have much life outside of its three-hour or so story, and a handful of hours afterwards. Kirby is once again relegated to a mediocre little release that few will play, and fewer will remember a year from now. The biggest grievance with this, though, isn't the mediocrity or the lack of innovation - it's the cost. This is certainly not worth the asking price and it would be far more appetising if it was a good 50% off the RRP.


DarkZero - Dominic Sheard - 5 / 10

After the year Nintendo has had, Kirby Battle Royale arrives on 3DS with a feeling that it is here to be the Christmas stocking filler, although an expensive one for what is included in the game.


FNintendo - Daniel Gomes - Portuguese - 6 / 10

If in theory Kirby Battle Royale had everything to work out, its execution turns out to be less ideal than expected. While the game stands out much more in multiplayer, it doesn't fully capture the player's interests in the long term and it feels more like a collection of minigames rather than an attempt to crossover the Kirby series with the fighting game genre.


GameMAG - Shibito - Russian - 5 / 10

Perhaps Kirby: Battle Royale will appeal to small children under the age of ten, but if you are slightly older, you can safely pass by.


God is a Geek - Nick Gillham - 6 / 10.0

Download play in Kirby Battle Royale will give a group a burst of fun, but after that it's unlikely you'll return for more.

The Kirby series has been no stranger to interesting spin-off titles over the years but, unfortunately, Kirby Battle Royale is one of his weaker ventures. A batch of modes uneven in quality, fairly basic combat and a repetitive story option make for a pretty forgettable experience when played alone. With a group, however, Kirby Battle Royale can be a silly, fun time albeit a relatively shallow one.

While a fun distraction, there's little to recommend wholeheartedly when it comes to Kirby: Battle Royale. Its mini-games are well designed, but with a short Story Mode and limited replay value for its other modes, it becomes clear that this is not a stellar addition to an already bulging line-up. Kirby fans are probably better off saving for a Switch as the pink puffball is heading there next year.


VGN - Filippo Ceron - Italian - 6.5 / 10.0

An overall enjoyable and easy to get experience which combines features from beat 'em up and party game genres. Kirby Battle Royale is very fun to play together with some friends via its local multiplayer, but the lack of variety for the included mini-games makes the single player soon boring, while the Online mode surprisingly presents some major technical issues.


Wccftech - Dave Aubrey - 5.5 / 10.0

Two years ago, I can imagine Kirby: Battle Royale having a great online following and loads of people getting together at StreetPass events to play with one another. Now? Kirby: Battle Royale is honestly best left in the past. Nintendo still has a chance to redeem this game, simply by porting it to the Switch and allowing for multiplayer on a single, big screen. But until then? Just don't bother. The minigames aren't all bad, but it just doesn't feel worth it as a full price retail release.

Bosses and Health Bars (Or Lack Thereof)

Something I've been curious about: why do some games with boss battles not give them visible health bars? That seems like the sort of thing that should be a given by this point, right? It's always good to see how well you're doing when fighting a boss, cause unless it's Mario-style "about three hits on the weak spot and they're dead" or they have obvious tells/body damage/phase shifts, you can have no clue how far you've gotten in a boss fight when you're new to it, and it can feel rather demotivating with repeated losses, especially if there's a time limit too. A friend of mine shared this feeling of frustration with me, saying that with no boss health bars during battle he felt like he wasn't achieving anything, just surviving through lucky RNG patterns. At least that game was nice enough to show you how far you got after you died...good thing the friend didn't try Monster Hunter or something...

So why do you think some games don't give their bosses visible HP bars? Do you think it's ever a good thing to not show boss health, or should it always be a given? How well do you think games that show boss damage in other ways (like Monster Hunter and such) convey how close to potentially victory you are? Feel free to share thoughts below!
